Vincent Jackson's DUI troubles

Anyone else aware of ehat's going on here? I just read he had a pending trial on an existing problem. (he screwed up a second time and might miss some) Anyone(Coach) have the scoop on this?

Brent Schrotenboer, of The San Diego Union-Tribune, reports San Diego Chargers WR Vincent Jackson has asked the court to suppress evidence obtained during his Jan. 6 arrest on suspicion of drunken driving. Jackson's attorney said Jackson was forced to have blood drawn against his will after repeatedly requesting a breath test. His blood-alcohol content measured 0.17 percent, according to court records. If the motion carries, the blood test results would be suppressed. He pleaded not guilty to the misdemeanor DUI charges, and his next court date is scheduled for June.
 
Not to pile on, but I've always found it interesting how everyone (including myself) takes every opportunity to poke sticks at Cincinnati's litany of off-field problem children. This franchise (San Diego) hasn't exactly been full of choirboys over the past 3-4 years, including Jackson.

Kevin Acee, of the San Diego Union-Tribune, reports San Diego Chargers WR Vincent Jackson has looked very good during offseason practices.
Our view: Acee gushed about Jackson, saying "I can't see any reason why this isn't a jump-off year, where he makes a push to be considered one of the league's best receivers." The chances of a suspension for Jackson's second DWI arrest in the offseason diminish with each day, and the value he represents at his ADP of WR18 and 52nd player overall grows.
 
That arrest was 5 days before SD lost to Pit in the playoffs.

Drunks have the right to demand what test is offered to them in California? Thought it was universal that the officer picks the 1st and the drunk can obtain a 2nd of his preference at his/her own cost.

Noticed the blurb does not say VJ was denied his opportunity to get a 2nd test.
 
San Diego Superior Court judge on Thursday denied a request by Chargers receiver Vincent Jackson to suppress evidence obtained as a result of Jackson's Jan. 6 arrest on suspicion of drunken driving.

VJ's attorney argued that Jackson was forced to have his blood drawn against his will after repeatedly requesting a breath test instead, as was his right. Still sounds like this would be inaccurate - anyone able to confirm?
